Structuring and drafting changesLast year the focus was on providing for side pockets, gates and appropriate measures to regulate suspensions and redemption payments. In addition to the refinement of these levers in the fund constitutional documents, there has recently been important new case law that impacts on redemption in kind language and suspension of redemption payments. We will discuss our suggested drafting amendments in the light of these decisions. We will also look at variations in offshore structures being utilised by investors and managers.
