Court approval of a substantial distribution of trust capital for charitable and philanthropic purposes

Ogier advised a member of a high net worth family in relation to a proposed distribution from a trust of which he was a named beneficiary.  The trustee of the trust proposed to make a substantial and momentous distribution of $750m from the trust fund which was potentially adverse to the interests of the minors and unborn beneficiaries, and it therefore sought the Court's approval of the exercise of its power to make the distribution.

Ogier acted for the named beneficiary, who was also appointed as representative of the minor and unborn beneficiaries of the trust, and the Court duly gave its approval in December 2013.
