Cayman, Guernsey and Jersey – which jurisdiction has the best trusts law?

Three of Ogier's most senior trusts disputes lawyers from Cayman, Guernsey and Jersey are coming together to debate which of their jurisdictions has the best law.

Partners Rachael Reynolds (Head of Dispute Resolution for our Cayman office), Simon Davies (Global Head of Dispute Resolution, based in our Guernsey office) and Nigel Sanders (Head of Dispute Resolution in our Jersey office) all regularly appear in court on major trusts cases with millions of pounds at stake, but the events are the first time that they've gone head-to-head.

Contentious and non-contentious trusts work is a major part of offshore law, but from the perspective of trustees and intermediaries there is an open question about which of the offshore jurisdictions has the best legislation.

Simon said: "The trusts laws of Cayman, Guernsey and Jersey are subtly different – and those subtleties can be hugely important from the point of view of trustees and intermediaries, particularly on key questions of disclosure, mistake and firewall provisions.

"We'll all be fighting our corners and drawing on legislation and key judgments to make our case and settle the question of which is superior – may the best jurisdiction win!"

The events is being hosted by Ogier's Trusts Advisory Group, which combines expertise from the firm's leading Private Client and Trusts, Dispute Resolution and Corporate and Commercial teams across BVI, Cayman, Guernsey, Hong Kong and Jersey.

The seminars take place at Ogier's offices on The Esplanade in Jersey on Monday and at the Old Government House Hotel in Guernsey on Tuesday – both events start at midday, and there will be time for a Q&A session at the end of the presentations.
