IP, Tech and Digital

We know how important intellectual property is, particularly to technology and digital businesses.

Members of our cross-jurisdictional team have combined experience of over 30 years in this specialist area, having worked with tech and digital start-ups, SMEs and multinational corporations since before the dot.com boom of the early 2000’s.  We understand the regulatory, legal and commercial issues that affect clients in this industry, and we know how to cut through the complexity to drive value to the businesses we represent.

Our services include

Day one: structuring and setting up your business in a tax efficient manner, moving an existing business, staff and family offshore, preparing contracts for directors and employees, and buying, selling or leasing commercial and residential property.

Intellectual property: exploiting and protecting the value of your intellectual property through registration, ownership and licensing, and supporting you in all types of disputes, including infringement and passing off actions.

Government and regulation: obtaining the necessary licences and consents, such as business, housing and work licences, to operate in our jurisdictions, and dealing with immigration matters.

Investment: structuring and advising you on getting new debt and equity investment into your business, including joint venture and shareholder arrangements.

In Jersey, Ogier is a corporate member of Digital Jersey, the accelerator for the digital economy in the island. Members of our team regularly speak at and attend industry events and are well versed in the opportunities and challenges presented by developments in this space. We are committed to help shape and enable Jersey’s digital industry and we particularly support and encourage appropriately regulated growth in fast-moving areas such as fintech, digital health and e-gaming.

Most importantly, we recognise the potential that technology offers not only to digital businesses but also to those in more established industries who are challenged to change and evolve their traditional business models. We work with those operating in the digital sector itself at all levels of their development, and also with businesses that are being enhanced or disrupted by innovative technologies.

The digital market space is continually evolving and is an important part of Guernsey’s future.  Guernsey launched its Digital Greenhouse in January 2016 to stimulate and accelerate start-up and growth activity in the digital and creative sector, improve the skills, knowledge and experience people and business have with technology and digital services and promote the island as a stand out jurisdiction for entrepreneurship, and as a destination for new business and businesses.

Guernsey is seeking to continue its long history of entrepreneurship and continues to attract and develop innovation.

In Guernsey our team is committed to staying one step ahead in order to provide you with the best advice on potential new opportunities and/or foreseeable challenges. Members of our team frequently speak at and attend industry events including IP Commercial Group meetings. Our commercial awareness combined with our strong legal credentials mean that we can advise on matters from protecting your ideas to drafting outsourcing contracts. In the past year, Ogier has acted for clients in the technology, telecoms, aviation and retail sectors.

First class infrastructure and networks, backed by a business friendly legal framework and a culture of trust and security make Luxembourg a prime business location for companies from the sectors of digital audio -visual content (including music downloads, online gaming, video-on-demand and pay TV) and new technologies and e-commerce, such as SES Astra, RTL, Amazon, eBay, iTunes, Skype, Vodafone and PayPal.

Luxembourg is further eager to position itself among the most advanced countries when it comes to innovative start-ups and emerging ICT businesses. In 2014, the government launched the 'Digital Lëtzebuerg'-initiative in order to further develop the digital economy, promote e-government and encourage the uptake of digital skills. In April 2015, Luxembourg was awarded 9th overall ranking in the Global Information Technology Report published by the World Economic Forum.

In Luxembourg, Ogier is committed to encourage the growth of emerging IP/ICT businesses and come along with their clients to help them to legally secure their projects in a dynamic and changing global risk environment.
