Mathew Newman to speak on insolvency outside the EU as Brexit debate intensifies

Ogier's Head of Dispute Resolution in Guernsey Mathew Newman is speaking at the SG Legal Conferences Insolvency Litigation 2019 Conference next week in London on life outside the EU in relation to insolvency and enforcement of judgments, with a particular focus on Guernsey's constitutional and regulatory position.  Mathew's session will be co-presented with Jeremy Golding QC of South Square chambers.

With new developments on Brexit by the hour, R&I practitioners are looking closely at the impact of Brexit on the constitutional position of the Crown Dependencies, which are key players in international restructuring and insolvency matters. Mathew's presentation will explore Guernsey's international insolvency regime and approach to the enforcement of foreign judgments, which demonstrate a robust and largely comity-friendly system, even without the benefit of EU reciprocal legislation.

Mathew said: "The uncertainty around Brexit continues, however it's important to reiterate that Guernsey is not in the EU, except for the purposes of free movement of goods, and therefore is not compulsorily subject to any EU legislation. This puts the Crown Dependencies in a distinct position to showcase how cross-border insolvency processes and foreign judgments can be easily and simply recognised and dealt with – both in and out of Guernsey – by using local legislation and customary law. I'm pleased to explore the implications of this at the upcoming Insolvency Litigation Conference."
