The fast track process is only available in estates where the deceased died domiciled in the British Isles, namely England and Wales, Scotland, Northern Ireland, Guernsey or the Isle of Man, and where a corresponding Grant of Probate/Letters of Administration has already been issued in that jurisdiction. It effectively enables the Jersey Court to 're-seal' the already issued Grant thereby reducing the time that it takes for a Jersey Grant to be obtained and the costs involved.
The application for a Jersey Grant via the fast track process must be made through a Jersey agent and Ogier would be pleased to be appointed to assist.
In order to obtain the Jersey Grant via the fast track process, Ogier will require the following:
Once the above documents have been received by Ogier, we will need to draft an Oath to send to the executors/administrators to sign and this must be done in the presence of a suitably qualified witness such as a solicitor or barrister. The signed Oath should then be returned to Ogier to enable us to make the application for the Jersey Grant. The Jersey Grant is usually issued within three and five working days of the application having being made to the Jersey Registrar.
Our fees for obtaining a Jersey Grant via the fast track process will be between £800-£1,000. If we are also instructed to assist with the transfer or collection and distribution of the Jersey assets then additional fees will be charged on a time costed basis.
Stamp duty is also payable to the Jersey Court when the application for the Jersey Grant is made. It is charged at the rate of 0.5% of the date of death value of the Jersey assets (which is rounded up to the nearest £10,000 for probate purposes) on estates with a value of up to £100,000 and at a rate of £75 per additional £10,000 thereafter. There is also an £80 probate application fee payable. Ogier can arrange to pay the amount due to the Court on behalf of the executor/administrators and can add it onto our invoice in due course.
