Four of Ogier's Dispute Resolution team in Hong Kong are named as Top Offshore Litigators by Asian Legal Business, recognising their delivery of exceptional client services on significant cases including the liquidation of Singapore-based cryptocurrency hedge fund Three Arrows Capital Ltd.
Asian Legal Business highlights the accomplishments of offshore law firm dispute practitioners. Inclusion on the list is determined by the significance of cases undertaken, client recommendations and feedback from the market.
Partner Oliver Payne has been named every year since the list first began in 2021. Cited as "pivotal in expanding Ogier's Disputes and Restructuring and Insolvency practice in the Asian market", he is head of Ogier's Dispute Resolution team in Asia, and has seen the team grow from three members in 2016 to 16 in 2024.
Significant cases referenced in the list on which Oliver acted for Ogier include the joint liquidators of Three Arrows Capital Ltd (3AC). Ogier, as BVI Counsel, was crucial in the application to appoint joint provisional liquidators and the subsequent winding-up proceedings against 3AC. He is representing Waterwood O2O Project Limited in Cayman fair value proceedings related to a US$125 million investment, as well as FamilyMart China Holding (FamilyMart China), regarding its shareholding in China CVS (Cayman Islands) Corporation, and Tianrui (International) Holding Limited in a winding up petition.
Partner Justin Davis is noted for his "adept handling of complex multi-jurisdictional matters". As well as his part in representing the jointing liquidators of 3AC, other highlights noted include an ongoing complex shareholder dispute in the BVI which also involves ongoing arbitration proceedings and valuable intellectual property assets in the People's Republic of China.
A new member of the team, partner Joanne Collett is described as "highly regarded for her insights into directors' duties and corporate governance in relation to the risk of corporate and finance transactions, along with significant expertise in take-private transactions". She is currently acting for the joint liquidators of Unigroup International Holdings and Tsinghua Unigroup International, which are both companies incorporated in the BVI with significant offshore USD-denominated debt.
Counsel Edwin Gomez specialises in Cayman Islands and BVI laws. He, too, was part of the team on the 3AC and FamilyMart China cases, and also represents the joint liquidators of CW Group Holdings, advising on the liquidation process and overseeing multi-jurisdictional proceedings and investigations related to the case.
