Ogier acts for joint liquidators of Eagle Holdings Limited

Ogier is acting for the joint liquidators of Eagle Holdings Limited in connection with an application to the Royal Court for directions to make a payment direct to a bank, which is a creditor of a wider group of companies as opposed to a creditor of the company itself.

The company's structure is complex, involving numerous group entities and limited partnerships with general and limited partners. Many of these entities in the group are insolvent, being dissolved, being struck off, or are bankrupt parties. The application's aim is to ensure that the monies are paid to a wider group of creditors as opposed to being paid to the crown as bona vacantia.

The matter involves novel law concerning the limited partnerships law in Guernsey and, in particular, the winding up and status of limited partnerships.

The Ogier team is being led by partners Sandie Lyne and Mathew Newman, with support from senior associate Michael Rogers and senior associate Fay Warrilow.
