Mistakes relating to trusts and foundations – an update on recent cases

In the matter of B and C v D, E, F and Others [2020] JRC 169, the Royal Court considered for the first time whether or not it had the power to set aside a Jersey Foundation for mistake.  Oliver will discuss this case and its implications, as well as providing an update on cases concerning mistakes relating to trusts and the practical issues that arise for settlors and trustees.

An update on the Financial Services (Disclosure and Provision of Information) (Jersey) Law 202-.

The Financial Services (Disclosure and Provision of Information) (Jersey) Law 202- is being introduced to deal with FATF recommendations regarding beneficial ownership and is due to come into force together with its related regulations and orders later this year. This legislation makes certain changes to the collection of beneficial ownership and significant persons information by the JFSC in relation to companies, foundations and other entities and determines the additional information which will or may be made public, in particular foundations. 

Does Jersey need a law change on the role environmental, social and governance (ESG) factors can play in trustee investment duties?

In the world of investment, there is growing momentum for change with investors calling for their money to make a positive impact on society and the world at large. Henry will explore the debate surrounding how this environmental shift in investment focus fits in with Jersey's current legislative landscape. He will consider the historic confusion about the ability and extent to which trustees should take ESG factors into account in their investment duties, the current position and how such duties are evolving.
