Catherine Moore will be presenting virtually for STEP Geneva discussing important areas to consider on a change in trustee covering both Guernsey and Jersey. 

A change of trustee involves a fair number of points for consideration, from issues relating to trustee liability to legal transfer of assets. The presentation will cover common areas of negotiation as well as issues we have seen arise including:

  • Trustee indemnities and chain indemnities;
  • Legal transfer of assets, including loan owed to or by trustees;
  • Third party consent requirements;
  • Restrictions on appointment of and location of new trustees;
  • Trustees de son tort.

Throughout the presentation she will give real life examples of scenarios we have seen and discuss case law on this area, providing tips to ensure a smooth handover of trusteeship.
