Successful application to remove a trustee of two Guernsey law trusts

Gavin Ferguson, Alice Bricogne and Sandie Lyne successfully acted in a case involving the removal of a professional trustee following the resignation of all of its directors (leaving two Guernsey trusts effectively paralysed) and the appointment of a local trust company as trustee in its place. The provisions of the two trust instruments were such that it was not possible either to remove the trustee or to appoint a new one without the assistance of the Guernsey Court.

Refusal of consent under Guernsey's AML reporting regime: balancing the rights of asset custodians and owners

The Financial Intelligence Service's refusal to consent to a proposed transaction under Guernsey's anti-money laundering reporting regime has resulted in the Royal Court deciding its first private law action between the person claiming the asset and the financial institution holding it.

Cayman dispute resolution team doubles in size in eight months

Ogier's Cayman Dispute Resolution team has doubled in size in the last eight months after a series of major instructions.

The new arrivals include Marc Kish, a lateral senior partner hire from another international offshore firm, Managing Associate Jennifer Fox; senior associates Ilona Groark and Gemma Lardner; associates Deborah Barker Roye and Rebecca Findlay.

BVI litigator Grant Carroll joins Ogier's Dispute Resolution team

Experienced BVI litigator Grant Carroll has joined Ogier's Dispute Resolution team as a managing associate. Grant – who specialises in shareholder disputes, contentious insolvency matters and commercial litigation – joins the team led by partner Brian Lacy. He previously worked in the jurisdiction for another offshore law firm, having practised as a commercial barrister in England for six years.
