Ogier and Serle Court are pleased to invite you to an exclusive seminar in Geneva examining two issues that are central to the effective administration of offshore structures: 

Trust restructuring: Commonly overlooked issues and lessons learned 
Trustee privilege: How and when privilege arises, and how it can be preserved 

This session is designed for senior fiduciary professionals, private client advisers and those working with high-net worth clients.

The seminar will feature two expert panels covering: 

Restructuring trusts: commonly overlooked issues and lessons learned 

Chaired by Ogier's Global Head of Private Wealth, Matt Guthrie, this panel will examine: 

  • points frequently missed in multi-jurisdictional trust restructuring exercises
  • managing fiduciary risk during structural change
  • lessons learned from recent complex mandates 

Matt leads Ogier’s Private Wealth practice globally and is widely recognised for advising high net worth families, trustees and family offices on sophisticated cross border structures. He is co-author of Guernsey Trust Law, the only text dedicated exclusively to trust and foundation law under Guernsey legislation and is regularly engaged in designing and implementing bespoke trust restructurings. 

The law of privilege: issues for trustees and how and when to preserve protection 

Chaired by Richard Wilson KC of Serle Court, this session will address: 

  • when privilege attaches in a trustee context
  • the boundaries of trustee disclosure obligations
  • best practice when instructing counsel and foreign counsel
  • common pitfalls in contentious trust environments 

Richard has appeared in many of the most significant trust cases of recent years, including Futter v Futter and Gany v Khan. His practice spans major offshore jurisdictions and frequently involves complex private international law issues. He has appeared before the Privy Council and appellate courts across key trust centres and regularly advises in high value cross border disputes.
